SEC’s spring 2024 regulatory agenda outlines upcoming FDTA implementation

The Securities and Exchange Commission (SEC) has published its Spring 2024 Regulatory Agenda, highlighting significant upcoming regulatory actions. One key item on the agenda is the Financial Data Transparency Act (FDTA), with the Notice of Proposed Rulemaking (NPRM) now scheduled for October 2024.

This adjustment in timing is noteworthy as other FDTA agencies, including the Consumer Financial Protection Bureau (CFPB), Federal Deposit Insurance Corporation (FDIC), National Credit Union Administration (NCUA), Federal Housing Finance Agency (FHFA), and the Treasury Department, have set their NPRM for July 2024. While the SEC typically schedules NPRM and Final Rules for either April or October, it’s possible that the rule could be published earlier.

In a statement on 8 July, SEC Chair Gary Gensler emphasised the Commission’s commitment to updating rules to align with contemporary market and technological developments. He highlighted the SEC’s ongoing efforts to promote market efficiency, integrity, and resiliency, ensuring that markets serve investors and issuers effectively. Gensler also underscored the importance of public input in shaping proposed rule changes.
